PFI contracts have been coming under increasing scrutiny over recent years in terms of the value for money that they deliver to the public sector and also the quality of the construction and FM services being delivered under the PFI banner.
High profile issues such as the brickwork failure at a number of PFI schools in Edinburgh and fire-safety issues identified at other PFI facilities has resulted in PFI being high on the political agenda. This, combined with the financial pressure on the public sector to implement significant savings strategies, has seen a greater focus on whether FM contractors are fully meeting their service obligations and, if not, are the appropriate Deductions being applied under the terms of the contractual Payment Mechanism for Availability and Performance Failures. Within our team we have significant knowledge, experience and expertise of PFI contracts, in respect of both operational and commercial elements and the key risks associated with the increased focus on Deductions.
